Terms of Service
These Terms of Service ("Terms") govern your use of the EventHelix.com website, the EventStudio and VisualEther software ("Software"), trial licenses, and any purchase made from EventHelix.com Inc. ("EventHelix", "we", "us"). By using the website, requesting a trial, or purchasing a license you agree to these Terms.
Last updated: 2026-05-13 (Professional / Server tier structure).
1. Who we are
EventHelix.com Inc. is a Maryland corporation headquartered in the State of Washington, United States. Contact: support@eventhelix.com.
2. The website
The content on EventHelix.com — articles, diagrams, tutorials, and documentation — is provided for informational purposes. You may read, link to, and quote short excerpts with attribution. You may not republish entire articles, scrape the site for bulk reuse, or remove copyright notices. All site content not contributed by third parties is © EventHelix.com Inc.
3. Software licenses
The Software is licensed, not sold. Each paid license is perpetual, non-exclusive, and non-transferable, and is governed by the license text delivered with the license file together with the rules in this section. The currently offered editions are Community, Professional, and Server.
3.1 Community Edition
VisualEther Community Edition is free to download and use, subject to the license terms shown in the installer and on the download page. Community Edition does not include the rights granted to Professional or Server licensees and may not be installed on a shared server or build agent.
3.2 Professional Edition
A Professional license permits use of the Software by one developer, on up to two machines (for example, a desktop and a laptop) used by that developer, for internal business purposes. Concurrent use by multiple people on a single Professional license is not permitted.
A Professional license does not authorise installation on a shared server, virtual machine, CI build agent, or other shared infrastructure used by multiple people or by automated systems on behalf of multiple people. That use case is covered by the Server Edition (see section 3.3). Personal automation by the licensed developer on machines covered by their Professional license — for example, the developer's own laptop running a local script or scheduled task — is permitted.
3.3 Server Edition
A Server license permits, for one VisualEther product family (e.g. VisualEther), both of the following:
- One server, virtual machine, or CI build agent install for automated, non-interactive use such as build pipelines, scheduled jobs, and shared MCP services; and
- Three developer seats, each on up to two machines (for example, a desktop and a laptop), for interactive workstation use of the Software by team members of the licensee.
The three bundled developer seats follow the same per-seat rules as Professional licenses in section 3.2 — one developer per seat, no concurrent use of a single seat by multiple people. Interactive use of the Software on the licensed server itself counts as use by one of the bundled developer seats.
3.4 How seats are tracked
EventHelix does not maintain a registry of individual developers. The licensee identifies, internally, which developer holds each seat under their Professional or Server license, and is responsible for ensuring that use of the Software stays within the limits in sections 3.2 and 3.3. Seats may be reassigned from one developer to another (for example, when an employee leaves the organisation), provided that at any given time the total number of developers using the Software does not exceed the number of seats licensed. License files must not be shared with anyone outside the licensee's organisation.
3.5 Volume and site licenses
Team, volume, and site licenses are governed by the quote and order confirmation. Where a quote, order confirmation, or signed agreement expressly addresses a topic also addressed in this section, the quote, order confirmation, or signed agreement controls to the extent of the conflict.
3.6 Updates
A paid license covers all maintenance updates of the purchased major version, and the period of included updates that is stated on your order confirmation (typically 12 months from the date of purchase). After that period you may continue to use the version you received indefinitely; ongoing updates require a separate annual maintenance renewal. Upgrades to a future major version are offered at discounted upgrade pricing.
3.7 Support
Email support via support@eventhelix.com is included for the period stated on your order confirmation (typically 12 months from the date of purchase for Professional and Server tiers). After the included support period, support may be obtained by renewing annual maintenance.
3.8 No reverse engineering, no redistribution
You may not reverse-engineer, decompile, or disassemble the Software, except where applicable law expressly permits it. You may not redistribute the Software, sublicense it, or share license files with anyone outside the developers and build agents covered by your license.
4. Trial licenses
Trial licenses are time-limited evaluation licenses provided free of charge so you can assess the Software before purchase. A trial license unlocks the full feature set of the paid editions, including features available under the Server Edition (for example, CI/build-pipeline integration, MCP services, and shared-server deployment).
For the duration of the trial, the trial license may be used to evaluate the Software on servers, virtual machines, and CI build agents, in addition to ordinary workstation evaluation. There is no separate "Server trial" — the Professional trial covers both workstation and server evaluation, so you can decide whether you need a Professional or a Server license before purchase.
A trial license is intended for bona fide evaluation and is bound to the email address used to request the trial. It is not a substitute for a paid license once your evaluation is complete: continued use of the Software on workstations requires a Professional or Server license, and continued use on shared servers or CI build agents requires a Server license. We may decline or revoke a trial license if the request appears automated, abusive, or aimed at circumventing the paid license. Trial licenses carry no support obligation beyond best-effort assistance.
5. Purchases and payment
Purchases on EventHelix.com are currently processed by FastSpring (Bright Market, LLC, trading as FastSpring), which acts as the merchant of record. FastSpring collects payment, calculates and remits applicable taxes (US sales tax, VAT, GST), and issues the receipt. Their terms of use apply to the payment transaction itself; see https://fastspring.com/legal/terms-of-use-fastspring-com/.
We may transition to Lemon Squeezy (Lemon Squeezy LLC) as merchant of record for future products. If and when that change is made, the merchant of record named on your receipt and these Terms will be updated accordingly.
After a successful purchase, our license-issuance pipeline emails your license file to the address you provided at checkout.
Prices are listed in US dollars and may change without notice. The price displayed at the time of your order is the price you pay for that order.
6. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
7. Acceptable use of the website
You agree not to:
- attempt to gain unauthorized access to the site, our license-issuance service, or any related infrastructure;
- submit automated trial-license requests, bypass the anti-bot check on the trial form, or use a single email address to request multiple trials in order to extend evaluation indefinitely;
- use the site or Software in violation of applicable export-control or sanctions law.
We may suspend access, revoke a trial, or refuse a purchase if we reasonably believe this section has been breached.
8. Intellectual property
EventStudio, VisualEther, and the EventHelix logo are trademarks of EventHelix.com Inc. Third-party trademarks referenced on the site (Wireshark, Microsoft Azure, Cloudflare, Lemon Squeezy, etc.) belong to their respective owners and appear for identification only.
9. Disclaimer of warranties
The website and the Software are provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Software will be error-free, uninterrupted, or that all defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our liability is limited to the minimum permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, EventHelix.com Inc., its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the website or the Software, even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or relating to these Terms or the Software is limited to the amount you paid for the Software in the 12 months preceding the event giving rise to the claim, or US$100 if you have not paid anything.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence, willful misconduct, or death or personal injury caused by negligence).
11. Indemnity
You agree to indemnify and hold harmless EventHelix.com Inc. from any third-party claim arising out of your breach of these Terms, your misuse of the Software, or your violation of applicable law.
12. Termination
Your right to use the Software terminates automatically if you breach a material term of these Terms — most importantly the license-scope rules in section 3. On termination you must stop using the Software and destroy any copies in your possession. Sections that by their nature should survive termination (disclaimers, limitation of liability, governing law) will survive.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be announced on the website. Continued use of the website or the Software after a revision takes effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of Washington, United States, and applicable U.S. federal law, without regard to its conflict-of-laws rules. The state and federal courts located in King County, Washington will have exclusive jurisdiction over any dispute arising out of these Terms, except that we may seek injunctive relief in any jurisdiction to protect our intellectual-property rights.
If you reside in a jurisdiction whose consumer-protection laws give you mandatory rights that cannot be waived by contract, those rights continue to apply.
